Reformulating the (d)(1) Use Variance Test of “Particular Suitability”

Commercial use variances present one of the more difficult problems in land use. Courts and treatise writers have struggled to nail down the “I know it when I see it” analysis. The test is called “particular suitability,” which doesn’t explain much. What does it mean? Anne has proposed a more helpful explanation, in an article recently published in the New Jersey Law Journal’s annual Real Estate special section, as well as in The New Jersey Planner, published by the NJPO.
